Integrity and Whistleblowing

1. Introduction

  1. MyPOWER has established a Whistleblowing Programme to provide a secure and confidential channel for all personnel, Directors, and external parties to raise genuine concerns or complaints regarding suspected wrongdoing, misconduct, or unethical behaviour in good faith. Reports may be submitted to the Whistleblowing Secretariat for appropriate review, investigation, and further action.
  2. MyPOWER is committed to protecting whistleblowers from any form of reprisal or retaliation arising from a report made in good faith. The identity of the whistleblower shall be kept confidential and protected to the extent permitted by applicable laws and regulations. However, protection under this Whistleblowing Programme shall not extend to individuals who knowingly make false, malicious, or frivolous reports, or submit complaints with improper motives.
  3. This Whistleblowing Programme is MyPOWER’s internal reporting mechanism.
  4. Statutory protection under the Whistleblower Protection Act 2010 is separately available where a disclosure of improper conduct is made to an enforcement agency (such as the Malaysian Anti-Corruption Commission or the relevant regulator), subject to the conditions of MACC Act.
  5. No provision of this Handbook or of any confidentiality undertaking given by an employee shall operate to preclude an employee from making such a disclosure to an enforcement agency, any such provision being void to that extent by operation of law.

2. For the purpose of this Whistleblowing Programme, “Wrongdoing” refers to, but is not limited to, the following:

  1. Fraud;
  2. Corruption or bribery;
  3. Breach of legal obligation;
  4. Misuse of confidential information;
  5. Acts or omissions which are deemed to be against the interest of the Company, laws, regulations or public interest;
  6. Gross mismanagement or abuse of power/ authority;
  7. Misappropriation of assets;
  8. Serious breach of code of conducts;
  9. Questionable/ improper accounting; sexual harassment; or
  10. Deliberate concealment of acts of wrongdoings.

3. Communication Channels

All complaints or concerns should be submitted to the Whistleblowing Secretariat through the following modes of communication:
